Government's Approach to Data Protection
IT and Electronics Minister Ashwini Vaishnaw announced on Tuesday that the government plans to consult with the technology industry before implementing any restrictions on the transfer of certain classes of personal data outside India. This move is part of the government's efforts to ensure a balanced approach to digital personal data protection, engaging not only industry representatives but also external experts in the process.
Consultative Approach to Draft Rules
The draft rules for the Digital Personal Data Protection (DPDP) law, introduced in 2023, suggest restrictions on the transfer of certain types of personal data abroad. Minister Vaishnaw emphasized the importance of a consultative approach, stating, "It will go as per sectoral requirements, or else be thoroughly examined and discussed with stakeholders. We also aim to engage with sector experts."
Impact on Major Tech Companies
This potential curb on data transfer could pose challenges for major social media and internet companies, including Meta, Google, Apple, Amazon, and Flipkart. These companies may express their opposition to the measure in their feedback to the ministry, which is accepting comments until February 18.
Focus on Safer Internet for Children
Additionally, the minister highlighted the proposal to mandate parental consent for children under 18 to join social media platforms, aiming to build safeguards for a safer internet environment.
